Please read these terms carefully before using our services

BULLETPROOF COURIER CONTRACT

Xplicit Shipping
Effective Date: 20 March 2026

1. LEGAL ACCEPTANCE

By using any service provided by Xplicit Shipping, the customer enters into a legally binding agreement and accepts all Terms and Conditions stated herein.

Failure to read these Terms does not exempt the customer from compliance.

2. CUSTOMER ACCOUNTABILITY (VERY IMPORTANT)

The customer agrees that:

  • All information provided is accurate and truthful

  • The declared value of items is honest and verifiable

  • They are the legal owner or authorized purchaser of all items shipped

⚠️ Any false declaration may result in:

  • Immediate suspension of service

  • Seizure of packages

  • Reporting to customs authorities

3. LIMITATION OF LIABILITY (CORE PROTECTION CLAUSE)

Xplicit Shipping is NOT liable for:

  • Loss, theft, or damage of packages

  • Delays in shipping or delivery

  • Indirect or consequential losses (e.g. lost business, missed deadlines)

Maximum liability, if accepted, is:

NOT the value of the item.

4. HIGH-VALUE ITEM PROTECTION CLAUSE

For items valued over USD $100:

  • Customers MUST declare accurate value

  • Proof of purchase may be required

Xplicit Shipping reserves the right to:

  • Refuse shipment

  • Hold items for verification

  • Adjust declared value

⚠️ Undervaluation = customer assumes 100% risk

5. CHARGEBACK & PAYMENT FRAUD PROTECTION

By using our services, the customer agrees:

  • NOT to initiate chargebacks or payment disputes after service is rendered

  • All payments are final once shipment processing begins

If a chargeback is initiated:

  • The customer will be blacklisted permanently

  • Any packages in possession will be held or confiscated

  • Legal action may be pursued to recover losses

6. NO REFUND POLICY

All payments made to Xplicit Shipping are:

  • Shipment is processed

  • Online purchase is completed

  • Package is received at warehouse

Exceptions are at the sole discretion of Xplicit Shipping.

7. THIRD-PARTY & VENDOR DISCLAIMER

Xplicit Shipping acts as a logistics intermediary only.

We are NOT responsible for:

  • Seller mistakes

  • Fake or defective items

  • Wrong sizes, colors, or products

  • Vendor delays or cancellations

All disputes must be handled between customer and vendor.

8. PACKAGE CONDITION CLAUSE

All packages are received and shipped:

We do NOT:

  • Open packages (unless required)

  • Inspect internal contents

  • Guarantee item condition

9. FRAGILE & ELECTRONICS CLAUSE

Items such as:

  • Phones

  • TVs

  • Glass

  • Appliances

  • Liquids

Are shipped:

No compensation will be provided for damage.

10. SHIPPING DELAYS DISCLAIMER

Xplicit Shipping is not liable for delays caused by:

  • Customs inspections

  • Airline issues

  • Weather conditions

  • Government regulations

  • Third-party couriers

Delivery timelines are estimates only, NOT guarantees.

11. DELIVERY & TRANSFER OF LIABILITY

Once a package is:

  • Delivered

  • Signed for

  • Handed to Knutsford / Zipmail / third-party courier

12. STORAGE & ABANDONMENT POLICY

  • Packages must be collected within 7 days

  • Storage fees apply after that

After 30 days:

Xplicit Shipping has the right to:

  • Sell

  • Dispose

  • Auction

To recover costs.

13. PROHIBITED ITEMS ENFORCEMENT

If prohibited items are discovered:

  • They will be confiscated immediately

  • No refund will be issued

  • Authorities may be notified

Customer bears full legal responsibility

14. TAX & CUSTOMS LIABILITY

Customers are fully responsible for:

  • Duties

  • Taxes

  • Customs penalties

Xplicit Shipping has zero control over customs decisions.

15. RIGHT TO REFUSE SERVICE

Xplicit Shipping reserves the right to:

  • Refuse any shipment

  • Deny service to any customer

  • Cancel accounts without explanation

Especially in cases of:

  • Fraud

  • Abuse

  • Suspicious activity

16. REFERRAL PROGRAM TERMS

  • Rewards apply only after completed shipment

  • Store credits are non-transferable and non-cashable

  • Abuse of referral system = account suspension

17. FORCE MAJEURE

Xplicit Shipping is not liable for failure or delay due to:

  • Natural disasters

  • Pandemics

  • Government actions

  • Strikes

  • Any event beyond our control

18. LEGAL JURISDICTION

This agreement is governed by the laws of Jamaica.

Any disputes shall be resolved within Jamaican courts.

19. AGREEMENT ENFORCEMENT

By using our services, the customer:

βœ” Accepts all risks associated with shipping
βœ” Agrees to full compliance

20. FINAL CLAUSE (POWER CLAUSE)

Xplicit Shipping operates with strict policies to ensure fairness, efficiency, and protection of operations.

Any attempt to exploit, manipulate, or abuse our services will result in:
